Please read these Terms of Use ("Terms") carefully before using the Janaza mobile application ("App") or the Janaza Online website ("Website"), collectively referred to as the "Service," operated by Janaza Online ("we," "us," or "our").
These Terms govern your access to and use of the Service. If you do not agree to any part of these Terms, you must not use the Service.
Acceptance of Terms
By creating an account, downloading the App, accessing the Website, or otherwise using the Service, you confirm that:
- You have read and understood these Terms
- You are at least 13 years of age (or the minimum age required in your jurisdiction)
- You agree to be legally bound by these Terms and our Privacy Policy, which is incorporated herein by reference
- If you are using the Service on behalf of an organization, you have the authority to bind that organization to these Terms
Description of Service
Janaza Online is a free community-oriented mobile application and website designed to help Muslim communities stay informed about Janaza (Islamic funeral) prayer services and events. The Service allows users to:
- Create a free account and manage notification preferences
- Subscribe to geographic areas (zip codes, cities, or radius) to receive Janaza event notifications
- View upcoming and recent Janaza events in subscribed areas
- Set personal reminders for events they wish to attend
- Receive push notifications about new, updated, or cancelled events
The Service is provided free of charge. We do not display advertisements. Certain administrative features (such as posting or managing events) are reserved for verified admin users only.
Janaza Online is a notification and community coordination tool — it is not affiliated with, endorsed by, or a representative of any mosque, Islamic organization, or funeral home.
Eligibility
The Service is intended for users who are at least 13 years old. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service and that they have read and agreed to these Terms on your behalf.
We reserve the right to refuse access to the Service to any person or entity at our sole discretion.
User Accounts
4.1 Account Creation
To access certain features of the Service, you must create an account using a valid email address and password, or through a supported third-party sign-in provider (e.g., Google Sign-In). You agree to provide accurate, complete, and current information during registration and to keep this information up to date.
4.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at [email protected] if you suspect unauthorized access to your account. We are not liable for any losses resulting from unauthorized use of your account due to your failure to safeguard your credentials.
4.3 One Account Per User
Each user may maintain only one account. Creating multiple accounts to circumvent restrictions or bans is prohibited.
4.4 Account Deletion
You may delete your account at any time through the app settings. Upon deletion, your account data will be removed in accordance with our Privacy Policy.
Acceptable Use
You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others. You must not:
- Post, submit, or transmit any content that is false, misleading, fraudulent, or intended to deceive
- Impersonate any person, mosque, organization, or community leader
- Use the Service to harass, threaten, or harm any individual or community
- Attempt to gain unauthorized access to any part of the Service, its servers, or its infrastructure
- Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App
- Use automated tools, bots, scrapers, or scripts to access or interact with the Service
- Introduce viruses, malware, or any other harmful code into the Service
- Use the Service for any commercial purpose without our prior written consent
- Attempt to circumvent, disable, or interfere with security-related features of the Service
- Violate any applicable local, state, national, or international law or regulation
Misuse of the Service — including posting false, fabricated, or disrespectful Janaza events — is a serious violation of these Terms and will result in immediate account termination and may be reported to relevant authorities.
User-Submitted Content
Certain features of the Service may allow authorized users to submit content such as event details, location information, and descriptions ("User Content"). By submitting User Content, you:
- Represent that you have the right to submit such content and that it is accurate to the best of your knowledge
- Grant Janaza Online a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content within the Service for the purpose of operating and improving the Service
- Agree that you will not submit content that infringes any third-party intellectual property rights, privacy rights, or applicable law
We do not claim ownership of your User Content. You retain all ownership rights you have in the content you submit. However, we reserve the right to remove any User Content at our sole discretion, particularly content that violates these Terms or that we deem disrespectful to the deceased, their families, or the community.
Admin & Event Posting
The ability to create, edit, and publish Janaza events is restricted to verified admin users. Admin access is granted at our sole discretion, typically to mosque administrators, Islamic center staff, and verified community leaders.
7.1 Admin Responsibilities
If you are granted admin access, you agree to:
- Post only accurate, verified information about Janaza events
- Obtain appropriate permission from the deceased's family or their representative before posting event details
- Promptly update or cancel events if circumstances change
- Treat all event information with the utmost respect and dignity befitting the occasion
- Not share your admin credentials with any other person
7.2 Admin Access Revocation
We reserve the right to revoke admin access at any time for any reason, including but not limited to violations of these Terms, posting inaccurate or disrespectful content, or misuse of the Service.
7.3 Request Admin Access
If you are a mosque administrator or community leader and wish to request admin access, please contact us at [email protected] with details about your organization.
Intellectual Property
The Service and all of its original content — including but not limited to the Janaza name, logo, app design, interface, code, text, graphics, and compilations — are and remain the exclusive property of Janaza Online and its licensors. All rights are reserved.
Nothing in these Terms grants you a right to use the Janaza name, trademark, logo, or other proprietary designations without our prior written consent.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App on your personal device solely for the purpose of accessing the Service in accordance with these Terms. This license does not include the right to sublicense, sell, resell, transfer, assign, or commercially exploit the Service or its content.
Third-Party Services
The Service relies on third-party services to operate, including Google Firebase, Apple Push Notification service, and Google Maps. Your use of the Service is also subject to the terms and policies of these third-party providers.
The Service may contain links to third-party websites or resources (such as map services or app store pages). These links are provided for your convenience only. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You access third-party services at your own risk.
We are not responsible for the availability or accuracy of any third-party services, and we do not endorse any products or services of third parties mentioned in the Service.
Disclaimers
10.1 As-Is Service
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, JANAZA ONLINE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10.2 No Guarantee of Accuracy
Janaza event information posted on the Service is submitted by community administrators and may not always be current, complete, or accurate. We do not verify all event information and are not responsible for errors, omissions, or changes in event details. Always confirm event details through direct contact with the mosque or organizer before attending.
10.3 Notification Delivery
We do not guarantee that push notifications or in-app alerts will be delivered in a timely manner or at all. Notification delivery depends on factors outside our control, including device settings, network conditions, and third-party notification services.
10.4 Service Availability
We do not guarantee that the Service will be available at all times, uninterrupted, or error-free. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JANAZA ONLINE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of data, revenue, profits, or goodwill
- Missed or delayed Janaza services due to notification failure
- Inaccurate event information posted by admin users
- Unauthorized access to or alteration of your transmissions or data
- Any other matter relating to the Service
THIS APPLIES WHETHER THE CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
WHERE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES IS NOT PERMITTED BY LAW, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT ALLOWED BY LAW. IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM (OR $0 IF THE SERVICE WAS PROVIDED FREE OF CHARGE).
Indemnification
You agree to defend, indemnify, and hold harmless Janaza Online and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights, including any intellectual property or privacy rights
- Any User Content you submit to the Service
Termination
We reserve the right to suspend or terminate your access to the Service at our sole discretion, immediately and without prior notice, for any reason including but not limited to:
- Violation of these Terms
- Conduct that we believe is harmful to other users, the community, or us
- Fraudulent, abusive, or otherwise illegal activity
- Requests by law enforcement or government agencies
Upon termination, your right to use the Service ceases immediately. All provisions of these Terms that by their nature should survive termination — including ownership provisions, warranty disclaimers, indemnity, and limitations of liability — shall survive.
You may terminate your own account at any time through the App settings. Termination of your account does not relieve you of any obligations incurred prior to termination.
Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the Service that cannot be resolved informally shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, with arbitration taking place in Cook County, Illinois. The arbitration shall be conducted in English. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Update the "Last Updated" date at the top of this page
- Send a push notification or in-app notice to active users
- For significant changes, send an email notification to the address on your account
Your continued use of the Service after revised Terms become effective constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service and delete your account.
